Summary

This report relates to the misconduct re-hearing of FPC Martin Binala.

The former officer faced a misconduct hearing which took place on 4-7 December 2023 and on 4 January 2024.

The decision of that panel was successfully appealed on 11 October 2024. This report relates to the re-hearing which followed that appeal. The re-hearing took place in June 2026. The re-hearing concerned the same events which were considered by the earlier Panel. There were fewer adverse findings found proven against the officer by the second Panel. The decision set out below sets out Panel's findings at the re-hearing in full.

Decision

The Chair of the proceedings, determined that two of the allegations were proven at the level of Gross Misconduct, one at the level of misconduct and all other not proven and that the Standards of Professional Behaviour had been breached, namely in respect of Authority, Respect & Courtesy, Use of Force, Duties & Responsibilities and Discreditable Conduct.

As a result, former PC Binala would have been dismissed without notice and will now be added to the Barred List held by the College of Policing.
