I note you seek access to the following information:
A recent misconduct hearing outcome notice records that the correct procedure in conducting a with cause alcohol test was not followed and that no copy of the relevant policy toolkit was in the box:
8. It is entirely clear that the relevant policy toolkit about how with cause alcohol testing [75] was not followed in this case. In particular, it requires a second reading to be taken by a person who has been trained in the procedure. Only the lower of the two readings will be relied upon.
9. Here, only one sample was tested. In our view, this is likely because the Inspector who took the sample had not been trained in the process. We also believe that a copy of the policy toolkit (or even a reference to the need to read it) should have been in the box. We want to be clear that we make no criticism of the Inspector, who we are satisfied was doing his best to take a fair test and to balance that with concern for the welfare of a police officer who was in a challenging situation.'
