I believe this adjustment (limiting the period to just one year and removing Diana Mosley) would make the request more manageable and could be addressed immediately. I also repeat the observations at 1-4 of my original request dated May 27 2025 (and which are appended below)
For the avoidance of doubt, I maintain my original request and will write further on that in due course.
I note your request pertains to information relating to Sir Oswald Mosley, Max Mosley, and/or The Union Movement, specially concerning the year 1962. As referenced in your Internal Review response letter (01/FOI/25/047334), our initial response to 01/FOI/25/045131/R focused on MEPO 38/3. However, it has since been acknowledged that the request should have referred to all information held by the MPS on the aforementioned subjects. With regard to your current request, which is limited to information in 1962 only, searches were conducted within both Counter Terrorism Policing London and Records Management. Although another file was identified during this process, enquiries with our Records Management team have confirmed that the file could not be located. Accordingly, the only relevant material identified in response to your request is contained within MEPO 38/3.
I have today decided to disclose some of the requested information. Some data has been withheld as it is exempt from disclosure and therefore this response serves as a Refusal Notice under Section 17 of the Freedom of Information Act 2000 (the Act). Please see the legal annex for further information on the exemptions applied in respect of your request.
Reason for Decision
Certain content within MEPO 38/3, specifically relating to information from 1962, has been withheld under exemption provisions due to the sensitive nature of the material. In particular, some of the information concerns police enquires conducted during the course of an investigation, as well as evidence gathered and recorded. All of this is exempt under Section 31(1)(a)(b) of the Act. Furthermore, Section 23(1) prohibits the disclosure of any material that would reveal the extent of involvement by security bodies through the release of the records.
