Freedom of information request reference no: 01.FOI.24.035009
I note you seek access to the following information:
In September last year, Graham Smith & the organisation Republic sued the Met for wrongful arrests & detentions, following the 'once in a lifetime' opportunity to protest peacefully & lawfully in a democracy against the Coronation of an hereditary monarch.
Since that action commenced, I can find no further public reference by the police.
Please could you disclose to me,
1) The case reference number, and Court name where the case is being heard
2) Full details of any settlement reached with Mr. Smith and/or Republic; particularly the date when that settlement was agreed, and the value of any financial compensation that has been paid
3) The costs to the Met of defending this case (if any)
Decision
I have today decided to disclose the located information to you in full.
Please find below information pursuant to your request above.
Q1 - The case reference number, and Court name where the case is being heard
These details are ‘accessible by other means’ and section 21 of the FOIA applies. Judicial Reviews are issued in the
Administrative Court.
You may apply under the Civil Procedure Rules 5.4C (Supply of documents to a non-party from court records) for any statements of case in the Judicial Review, which will include the case number.
Q2 - Full details of any settlement reached with Mr. Smith and/or Republic; particularly the date when that settlement was agreed, and the value of any financial compensation that has been paid.
Information not held. The proceedings are ongoing.
Q3 - The costs to the Met of defending this case (if any)
It is not possible to provide a full picture of the costs incurred so far by the Directorate of Legal Services (DLS) relating to the Judicial Review by Graham Smith.
In-house Costs – DLS staff and facilities:
Information not held. Basic costs such as facilities, e.g, stationery, etc, are not recorded on a granular level. In relation to staff costs, a number of in-house staff may have completed work associated with the case, including say Admin Assistants. Fee earners (our lawyers and paralegals) are the only ones who record the time they spend working on each case. We can supply the total amount of any time spent on cases by fee earners, but it is not possible to provide the cost of that time without calculating it using the Met’s Ready Reckoner. Therefore the cost of Directorate of Legal Services fee earners is not information that is ‘held’, as we would have to create information to answer the question.
External Costs – Counsel, Professional Fees and miscellaneous costs
The total cost of external counsel to date is £3,880 (excl VAT*), which has been paid to more than one counsel. There have been no Professional Fees or miscellaneous costs.
* The MPS is a Section 33 public body for VAT purposes and thus allowed to recover Input Tax on all expenditure subject to certain conditions.
