I note you seek access to the following information:
In relation to:
(a) the area under your jurisdiction; and
(b) the calendar year 2022
please confirm the following information about road traffic collisions (RTCs).
1. How many RTCs have occurred in which someone was killed or seriously injured (KSI)?
2. How many people have been arrested for driving offences in connection with these RTCs?
3. How many of those arrested for these offences have been
a) Charged with a driving related offence
b) Cautioned for a driving related offence
c) Released without charge or caution
4. Of those charged for a driving offence relating to an RTC in which someone was killed or seriously injured, how many were
a) Granted bail
b) Remanded in custody
5. Of those bailed for a driving offence relating to an RTC in which someone was killed or seriously injured, how many had a driving ban imposed as part of their bail conditions?
I have today decided to disclose some of the requested information. Some data has been withheld as it is exempt from disclosure and therefore this response serves as a Refusal Notice under Section 17 of the Freedom of Information Act 2000 (the Act) by virtue of the following exemptions:
Section 21(1) - Information which is reasonably accessible by other means
Reason for decision
Section 21 of the Act provides public authorities with an exclusion from the duty to disclose information, under Section 1(1)(b) of the Act, when the information requested is reasonably accessible to the applicant. This exemption is accordingly claimed in respect of the information requested that is already published. Where information is already in the public domain we are not required to re-publish the data, instead, public authorities are required to direct you to the information, which we have done in this instance.
With reference Q1 - How many RTCs have occurred in which someone was killed or seriously injured (KSI)? the Section 21 Exemption applies to this question as this data is published by TFL and is already in the public domain. I have provided a link below for your reference.
Disclosure
With reference to Q2 - How many people have been arrested for driving offences in connection with these RTCs? for the period requested, our records show that 112 arrests have been made in relation to RTCs. Please note, however, that this is not in relation to Q1 - How many RTCs have occurred in which someone was killed or seriously injured (KSI)? but the total number of arrests made for this offence.
In relation to Q.3 How many of those arrested for these offences have been, the number of recorded arrests for RTCs were as follows:
a) Charged with a driving related offence
30 arrests resulted in a charge
b) Cautioned for a driving related offence
No cautions were issued
c) Released without charge or caution
53 were NFA (No Further Action)
With reference to Q4 - Of those charged for a driving offence relating to an RTC in which someone was killed or seriously injured, how many were, following are the details:
a) Granted bail
b) Remanded in custody
a) 9 arrests resulted in a charge and bailed to court or were charged via postal charge
b) 17 arrests resulted in a charge and detained to court
c) 4 arrests were charged in the new application.
With reference to Q5 - Of those bailed for a driving offence relating to an RTC in which someone was killed or seriously injured, how many had a driving ban imposed as part of their bail conditions?
Of the 9 people, 4 of them had a condition to not use a vehicle prior to the first court hearing. Please note that these are pre-court bail conditions.
