Dates of hearing: 20 to 22 January 2024
The allegations as set out in the Regulation 30 Notice served upon the officers under the Police (Conduct) Regulations 2020 are that PC Barnes and PC McAleenan:
(i) heard Mr Clarke say that he could not breathe
(ii) failed to execute their duty to ensure Mr Clarke's welfare and
(iii) made a statement under oath which was both dishonest and lacked integrity
Having considered all relevant evidence very carefully, the Panel finds it Not Proved that either PC Barnes or PC McAleenan heard Mr Clarke say that he could not breathe.
It follows that there can be no misconduct.
