Notice for hearing to be held in private – 1st March 2021

Police Sergeant Gary Willis currently based at Met Detention, will answer allegations that his conduct amounts to a breach of Standards of Professional Behaviour, in respect of:

  • Duties and responsibilities
  • Honesty and integrity
  • Discreditable conduct

It is alleged that on the 26th April 2018 PS Willis dealt with a detainee that had been arrested on suspicion of drink drive and failing to stop. PS Willis did not make accurate records in the custody record or other records relating to the Evidential Breath Machine results.

PS Willis failed to ensure the detainee was charged for the drink drive offence and applied the wrong threshold whilst dealing with the detainee. Had PS Willis applied the correct threshold, the detainee would have been charged with the offence of ‘drink driving’.

It is also alleged that PS Willis failed to charge the detainee for the offence of failing to stop and/or take further steps to enquire if the detainee should be charged. PS Willis failed to keep any record of decisions made in relation to the potential fail to stop offence.

It is further alleged on the 24th September 2017 whilst dealing with a detainee that had been arrested on suspicion of drink drive. PS Willis did not make accurate records in the custody record or other records relating to the Evidential Breath Machine results.

PS Willis failed to ensure the detainee was charged for the drink drive offence and applied the wrong threshold whilst dealing with the detainee. Had PS Willis applied the correct threshold, the detainee would have been charged with the offence of ‘drink driving’.

It is alleged that PS Willis intentionally recorded incorrect results in the detainees custody record and deliberately destroyed evidential results

It is alleged that on both occasions PS Willis applied his own discretion whether the detainees should be charged rather than following the mandatory guidance of the level at which persons should be charged.

It is alleged that in acting in this way PS Gary Willis breached the Standards of Professional Behaviour in respect of ‘Duties & Responsibilities, Honesty & Integrity and Discreditable Conduct’.

It is further alleged that this conduct, if proven, amounts individually or collectively to gross misconduct and is so serious as to justify dismissal.

The hearing will start on Monday 1st March 2021 and is listed for five days.

Due to the current COVID 19 pandemic, it is necessary to hold the hearing in private. An update will be published on conclusion of the hearing.

The identity of victims/witnesses will be protected during the hearing as appropriate.
