I note you seek access to the following information:
Request 1:
1. How many complaints have been made by people concerned about the possibility of domestic violence did you record your force area for 1 Jan 2019-31 Dec 2019; 1 Jan 2020-31 Dec 2020; 1 Jan 2021-31 Dec 2021; 1 Jan 2022-31 Dec 2022 under the Domestic Violence Disclosure Scheme - known as Clare's Law?
2. Please break these into the specified years along with their corresponding gender and ethnicity.
3. For 1 Jan 2019-31 Dec 2019; 1 Jan 2020-31 Dec 2020; 1 Jan 2021-31 Dec 2021; 1 Jan 2022-31 Dec 2022 how many disclosures did your force make warning people that their partner was potentially violent or had convictions for domestic violence?
4. Please break these into the specified years along with their corresponding gender and ethnicity.
Request 2:
1. How many complaints of domestic violence did you record your force area for 1 Jan 2019-31 Dec 2019; 1 Jan 2020-31 Dec 2020; 1 Jan 2021-31 Dec 2021; 1 Jan 2022-31 Dec 2022?
2. Please break these into the specified years along with their corresponding gender, ethnicity, and outcome.
3. For 1 Jan 2019-31 Dec 2019; 1 Jan 2020-31 Dec 2020; 1 Jan 2021-31 Dec 2021; 1 Jan 2022-31 Dec 2022 how many victims of domestic violence died or were murdered?
4. Please break these into the specified years along with their corresponding gender, ethnicity, and outcome.
I emailed on 12 January 2023 with the following ‘I have been advised that we have multiple Service Flags relating to Clare’s Law:
DE - Clare's Law: Nothing to Disclose
DF - Clare's Law: Person at risk disengaging
DG - Discontinuance Granted
DH - Clare's Law: Right to Know Requested
DI - Clare's Law: Right to Ask Requested
DJ - Clare's Law: Disclosure Made
DK - Clare's Law: Disclosure not made
Request 1
With regards to question 1 and 2 of request 1 please could you clarify if you would like us to provide victims by ALL codes in the above list or certain ones?
Questions 3 and 4 would this be for code DJ (Clare’s Law: Disclosure made) only?
Request 2
With regards to Questions 1 and 2 we can provide Victims of DA by gender and ethnicity
Question 3 & 4 we can provide a list for DA limited by offence of Murder if you are happy with this along with gender and ethnicity. However, the Homicide list doesn’t have Outcomes.
The last thing we need to clarify is what you mean by Outcomes? These are Offence based whereas the other questions are victim based so we cannot provide outcomes with gender/ethnicity in the same run. We can do Outcomes separately for DA if you are happy with this?
You responded on the same day with the following:
Request 1 - all codes please so I can provide context in my report.
Q3 & 4 - yes please as you have suggested.
Request 2 - no problem about Q3 & 4 as you have suggested. By outcomes I mean whether they were charged or not enough evidence to prosecute.
I then contacted you on 9th February 2023 to explain that we would be unable to provide the gender and ethnicity of the person who has requested or has disclosed information under Clare’s Law as we would need to read through each record and this would result in a cost refusal. You agreed that you were happy to remove the gender and ethnicity from your request.
