I have today decided to disclose some of the requested information. Some data has been withheld as it is exempt from disclosure and therefore this response serves as a Refusal Notice under Section 17 of the Freedom of Information Act 2000 (the Act) by virtue of the following exemptions:
Section 21(1) – Information reasonably accessible by other means
Section 40(2)(a)(b)(3A)(b)(3B)(4A)(b) - Personal Information
Reason for decision
Firstly, I am pleased to be able to inform you that MPS Fleet data is regularly published on the MPS website and the published data includes the number of beat/patrol, traffic, cell, and camera vans, currently in the MPS Fleet. Section 21 of the Act has therefore been applied to refuse disclosure of that information in this case.
Our most recent published Fleet data, published in March 2023, can be accessed direct at the link below:
Section 21(1) – Information reasonably accessible by other means - The information requested has been identified as being accessible via other means as it is already published. Where information is already in the public domain we are not required to re-publish the data; instead public authorities are required to direct you to the information, which we have done in this instance.
Section 40(2)(a)(b)(3A)(b)(3B)(4A)(b) - Personal Information - Please also be advised that Section 40(2)(3) of the Act, which provides an exemption for personal information, has been applied to refuse disclosure of the names of our current Fleet Manager, and assistant Fleet Manager. Disclosing this information would identify living individuals. Individuals employed by the MPS would not reasonably expect their names to be published in response to a FOIA request, and in connection with their employment with the MPS, and I have found that as no prior consent has been given to release this personal data any release would accordingly be unfair to them. Disclosure would also breach the principles of the Data Protection Act 2018 (DPA), and the General Data Protection Regulation (GDPR) and in the case of legitimate processing it is not appropriate to release this information.
