Recently our Chair, sent out a communication to the NPCC regarding confidentiality agreements imposed by Forces in relation to Employment Tribunal claims. As the staff association for constables, sergeants and inspectors we would like to get an accurate statistical overview of the number of these agreements across the country.
Please provide us with the total number of these type of agreements by year for the previous five calendar years from January 2017 to date.

SUPPORTING INFORMATION
The information located was extracted from the DLS case management system on the 15 February 2023 and sets out the number of Compromise Agreements and COT3s reached in Employment Tribunals against the MPS from the 1 January 2017 to 31 December 2022.
Please note that a COT3 is a written agreement entered into via the Advisory, Conciliation and Arbitration Service (ACAS) to settle an actual or potential Employment Tribunal claim. The ACAS is an independent public body that supports employers, employees and their representatives in resolving workplace disputes.
Settlements are only reached when both parties agree and have opportunity to obtain independent legal advice on the terms. In those circumstances where a confidentiality clause is included within a settlement, this is a decision that will have been reached following agreement between both parties. We keep the use of such clauses under review.
