I note you seek access to the following information:
I would like the organisation to review my freedom of information request below, that’s focused around contract data for services around facilities management.
1. Office and building cleaning – Service contract that is focused around office, commercial and building cleaning services.
2. Lift service and maintenance – Service contract for lift service and maintenance.
3. Food – Service contract that is focused around catering services.
4. General waste services contracts – The organisation’s primary general waste service contract.
5. Laundry services where clothes and linen can be washed and ironed.
Contract profile questionnaire for each type of contract:
1. Supplier/Provider of the services
2. Total Annual Spend – The spend should only relate to each of the service contracts listed above.
3. A description of the services provided under this contract please includes information if other services are included under the same contract.
4. The number of sites the contract covers
5. The start date of the contract
6. The end date of the contract
7. The duration of the contract, please include information on any extensions period.
8. Who within the organisation is responsible for each of these contracts? name, Job Title, contact number and email address.
You may have received the same request in the past. The information sent has now expired and I required an update as soon as possible. If all the information besides the contract dates are the same, I am happy to just receive an update on the contract dates.
I have today decided to disclose some of the requested information. Some data has been withheld as it is exempt from disclosure and therefore this response serves as a Refusal Notice under Section 17 of the Freedom of Information Act 2000 (the Act) by virtue of the following exemptions:
Section 40(2)(a)(b) & (3)(a)(i)) - Personal Information
Reason for decision
Section 40(2)(a)(b)&(3)(a)(i) – Personal Information - Under Section 40(2) and (3) of the Act, Public Authorities are able to withhold information where its release would identify any living individual and breach the principles of the Data Protection Act 2018 (DPA). I have applied this exemption in that the disclosure of the requested information could cause a living person's identity to be revealed.
If this occurs due to the information provided by the MPS, this constitutes personal data, which would be in breach of the rights provided by the DPA.
The eight principles of the DPA govern the way in which data controllers must manage personal data. Under principle one of the DPA, personal data must be processed fairly and lawfully.
In reaching my decision I have given due regard to Condition one and six of Schedule 2 of the DPA.
I have claimed this exemption as we consider that the names and contact details of persons responsible for the contracts relevant to this request are considered personal information. Their names are not currently in the public domain in association with these contracts and were we to release their names together with their contact numbers and email addresses, this would breach the right to privacy afforded to persons under the Data Protection Act 2018 (DPA) and the General Data Protection Regulation (GDPR).
The individuals concerned would not reasonably expect their names to be published by the MPS and I have found that as no prior consent has been given to release this personal data any release would accordingly be unfair to them. In the case of legitimate processing we do not consider that it is appropriate to release this information.
