I have today decided to disclose some of the requested information. Some data has been withheld as it is exempt from disclosure and therefore this response serves as a Refusal Notice under Section 17 of the Freedom of Information Act 2000 (the Act) by virtue of the following exemptions:
Section 40(2) – Personal Information
Reason for decision
Section 40(2)(3)&(4) – Personal Information - The Freedom of Information Act provides an exemption for Personal Data and this is known as the section 40 exemption.
Section 40 exemption applies to the breakdown by the type of sexual misconduct reported, namely, “…rape and sexual assault,...” This is because there are low numbers for some specific types of sexual offences and we therefore believe that this would lead to the identification of individuals.
Where the request is seeking access to third party personal data the section 40(2) exemption may be engaged.
Disclosure
The MPS has produced data around all FOI requests received recently around the number of cases involving police officer/staff sexual offence allegation.
The attached data does include answer to part of your request as well as additional data from other applicants on the same subject i.e. sexual offences.
